1. As to Defendant B’s KRW 90,000,000 and KRW 30,000 among them, Defendant B’s KRW 20,000 from September 7, 2013 to the Plaintiff.
Reasons
1. Determination as to Defendant B
A. In addition to the purport of the entire pleadings in the evidence evidence Nos. 1 through 8, the Plaintiff loaned KRW 1.30,000,000 to Defendant B on April 7, 2008 as interest rate of KRW 2%. ② The Plaintiff lent KRW 20,000,000 on February 8, 2010 as interest rate of KRW 2% and the maturity date of payment as of February 6, 2011. On April 6, 2013, the Plaintiff agreed with Defendant B on KRW 50,000 on interest rate of KRW 2% on the above aggregate, maturity date of payment on July 6, 2013, ③ the Plaintiff did not pay KRW 40,000 on August 6, 2013 to Defendant B as interest rate of KRW 20,000 on the loan or delayed payment from KRW 30,000 on the loan from KRW 31,203.31,2013.
B. According to the above facts, Defendant B is obligated to pay to the Plaintiff the agreed interest or delay damages calculated at the rate of 24% per annum from September 7, 2013 to September 8, 2013 with respect to KRW 20,000,000 as to KRW 30,000 as to KRW 30,000 as to the borrowed money (i.e., KRW 30,000 as to KRW 30,000 as to the borrowed money), and (ii) as to KRW 20,00,00 as to KRW 20,00,00 as to the borrowed money (i.e., KRW 40,00 as to the borrowed money) from September 6, 2013 to the day of full payment.
2. Determination as to Defendant C
A. The plaintiff's assertion that the defendant C borrowed the above money from the operating fund of the advertising agency, jointly with the defendant B, with the children of the defendant B, while operating the advertising agency, and the above money was transferred to the account in the name of the defendant C. The defendant C is jointly liable to pay the above borrowed money.
B. According to the facts and evidence as seen earlier, the Defendants are mother-and-child relationship, and the Plaintiff transferred the above 2 and 3 loans to Defendant C’s account.
