1. Details of the disposition;

A. The Plaintiff is the owner of Han River 3, Yongsan-gu, Seoul, 40-105 Railroad site 40-1005; 3, Han River 3, Yongsan-gu, Seoul, 40-1006 Railroad site 40-1006; 3, Han River 3, Yongsan-gu, Seoul, 40-1009 railway site 1913.5 square meters; 40-1026 railway site 8759.2 square meters; 3, Han River 3, Yongsan-gu, Yongsan-gu, Seoul; and 40-1027 square meters for railway site 996.5 square meters (hereinafter “each land of this case”); and individual land of Yongsan-gu refers to “40-105 square meters”; and

나. 피고는 2015. 2. 16. 서울특별시로부터 2015년 토양오염실태조사(토양환경보전법 제5조 제2항, 토양환경보전법 시행규칙 제3조 제1항 참조) 대상 지점을 선정제출하라는 요청을 받고 2015. 3. 6. ‘40-1005 토지’를 대상 지점으로 선정제출하였다.

피고는 2015. 9. 3. ‘40-1005 토지’에 관하여 토양오염실태조사를 실시하면서, 4개 지점(시료번호 22-1 내지 22-4)에서 시료를 채취하여 서울특별시보건환경연구원장에게 시료분석을 의뢰하였다.

As a result of the sample analysis, it was found that the sample collected at three points (number 22-1 to 22-3) exceed the base level of the pollution level of copper (Cu), lead (Pb), and Zn (Zn).

다. 이에 피고는 ‘40-1005 토지 일대’가 토양오염실태조사의 결과 우려기준을 넘는 지역에 해당한다고 보고(토양환경보전법 제5조 제4항 제2호), 그 소유자인 원고가 정화책임자라고 판단하여 2016. 3. 2. 원고 산하 국토교통부장관에게 ‘40-1005 토지 일대 34,870.9㎡’에 관하여 이행기간을 2016. 3. 10.부터 2016. 9. 9.까지(6개월)로 정하여 토양정밀조사명령 토양환경보전법 제15조 제1항 참조, 이하 '이 사건 처분'이라 한다
