A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant, at around 18:30 on October 20, 2017, without obtaining a driver's license on the three-lane road in front of C2 factory C, which is located in Gwangjuyang City B, and while under the influence of alcohol, driving D NAS car under the influence of alcohol.

도로변에 주차되어 있는 E 트럭을 들이받은 후 전남 광양시 F에 있는 G 주차장에 이르러 차를 주차해 두고 잠을 자던 중, 교통사고 신고를 받고 현장에 출동한 광양경찰서 H파출소 소속 경사 I이 위 G 주차장에서 주차된 승용차 운전석에 앉아 있던 피고인을 발견하고 발음이 부정확하고 횡설수설하며 눈이 충혈되어 있는 등 피고인에게 음주운전을 의심할 만한 정황이 있어 19:14경 1차, 19:19경 2차에 걸쳐 음주측정기에 입김을 불어넣는 방법으로 음주측정에 응할 것을 요구하였으나, 입김을 불어넣는 시늉만 하고, 3회째 음주측정 요구를 받자 현장에서 50m 가량을 뛰어 도주하는 등 정당한 사유 없이 경찰공무원의 음주측정 요구에 응하지 아니하였다.

1. Aggravation of concurrent crimes among concurrent crimes as prescribed in the former part of Article 37, Article 38 (1) 2, and Article 50 of the Criminal Act (within the scope of the sum of the long-term punishments of the crimes above two crimes), among concurrent crimes;

The Defendant, on the grounds of sentencing under Articles 53 and 55(1)3 of the Criminal Act for discretionary mitigation, was punished twice by a fine due to drunk driving, and the Defendant thereafter, once driving under the influence of alcohol, shall be punished by imprisonment for a period of up to 2017.
