Reasons
Punishment of the crime
1. In such a case, the defendant, who is engaged in the physical sale business, has a duty of care to verify whether he/she is stolen by ascertaining the personal information of the seller and entering the details in the transaction ledger, and by checking the details of the acquisition of electric wires, the motive for the sale, and the price suitable for the transaction price.
However, the Defendant neglected such care and did not enter the personal information of A in the transaction book, but did not confirm the process of acquiring the electric wires properly, and instead neglected the judgment on the stolen goods, as described in paragraph 1, and acquired the stolen and stolen electric wires by occupational negligence.
3. Defendant C is a person engaged in water-related business under the trade name “I” in Gwangju Northern-gu H.
