Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

B On June 13, 2018, the 7th local election of the Donam City/Do council member, which was implemented on June 13, 2018, was selected as a candidate for a D party, and the defendant is a person in charge of accounting in B.

1. A political party, candidate, election campaign manager, chief of the election campaign liaison office, accountant in charge, or assistant in financial affairs who violates the Public Official Election Act shall not disburse election expenses in excess of 1/200 of the restricted amount of election expenses publicly announced under the Public Official Election

Nevertheless, from March 2, 2018 to June 12, 2018, the Defendant and B disbursed more than 1/200 of the restricted amount of election expenses announced by the FF Election Commission (22,00 won) by spending more than 44,642,40 won (22,00 won) more than 1/200 of the restricted amount of election expenses announced by the FF Election Commission, including the election expenses of KRW 2,620,00,000, and the expenses for production of name cards for election campaigns at election campaign offices in south, from March 2, 2018 to June 12, 2018, and of KRW 242,404).

Accordingly, the defendant and B conspired to pay election expenses in excess of 1/200 of the restricted amount of election expenses publicly announced by the Public Official Election Act.

2. No person in charge of accounting of the election expenses shall fail to make an accounting report provided for in the provisions of the Political Funds Act without any justifiable grounds, or make any false entry, forge, alter or omit such accounting report;

Nevertheless, on July 10, 2018, the Defendant made the F. G’s accounting report at the F. G Election Commission located in Namnam, and added KRW 760,000 to the election expenses when the expense expense exceeds the restricted amount of election expenses, the Defendant omitted the said expense in the accounting report.

Accordingly, the defendant omitted 760,000 won in the accounting report for preliminary candidate election campaign in order to conceal the disbursement of election expenses without any justifiable reason.
