A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Fraud;
A. On August 10, 2015, the Defendant: (a) around 18:20 on August 10, 2015, at the “E restaurant” of the victim D’s operation in Jeju-si; and (b) as if he did not have the intent or ability to pay the price even if he was provided with alcohol and meals, the Defendant was provided with the victim’s total sum of KRW 14,000, such as two disease and blades on the job.
B. On August 14, 2015, the Defendant: (a) around 21:00, at the “H restaurant in the operation of the Victim G G in Jeju City F; and (b) as if he did not have the intent or ability to pay the price even if he was provided with alcohol and meals, the Defendant was provided with the sum of KRW 10,000,000, such as 1 disease and bean tree on the job by the victim.
C. On August 16, 2015, the Defendant: (a) around 13:30 on August 16, 2015, at the “K cafeteria” in the operation of the Victim J in Jeju City; and (b) as if he did not have the intent or ability to pay the price even if he was provided with drinking and meal, the Defendant was provided with the sum of KRW 14,00,000, such as 2 sicks and gress, at the same place.
2. On August 16, 2015, the Defendant: (a) around 14:40 on August 16, 2015, at the “K cafeteria” as indicated in paragraph (c) of Article 1, and received a report on the fact that he did not pay the price after drinking alcohol; (b) the Defendant was arrested the head of the Dong-dong Police Station L District M with the police station affiliated with the Jeju Dong-dong Police Station, who was called for, and received a notification on the fact that he did not pay the price; and (c) the head of the Dong-dong Police Station, who was arrested him at a low time.
Accordingly, the defendant interfered with the legitimate execution of duties of police officers on the prevention, suppression and investigation of crimes.
