Reasons
Punishment of the crime
On August 22, 2013, the Defendant was sentenced to imprisonment with prison labor for fraud, etc. at the Incheon District Court on November 14, 2013 and the judgment became final and conclusive on November 14, 2013.
The Defendant purchased a large number of unspecified personal information via the Internet with B, etc., and then sent text messages, such as “it is possible to borrow KRW 2 million only on the basis of identity verification,” or made phone calls to loan applicants in need of urgent transfer, and received a copy of identification card from the victim by facsimile, etc., and then received it by the victim’s request for opening of the cell phone in the name of the victim, thereby allowing the victims to receive the opening of the cell phone and the cell phone device, and imposing the fees on the victims, and to acquire profits by disposing of the cell phone in the name of the victim or by disposing of the cell phone after deducting the core chip, and by disposing of the mobile phone, the Defendant, along with the provision of funds and management of the entire business.
On June 20, 2012, the Defendant: (a) made a false statement to the effect that “only if a person opens a mobile phone via the mobile phone number of the victim F, it is possible to lend the mobile phone; and (b) made a false statement to the effect that “on the face of a telephone call from the telecommunications company, it shall be limited to 4,00 if the telephone is off; and (c) obtained a photograph of the resident registration certificate as necessary for the loan, by transmitting the copy of resident registration to the mobile phone, and using the copy of the resident registration certificate by facsimile, thereby taking over two cell phoness (G and H) of the mobile phone amounting to KRW 800,000,000 in total, from the victim’s liability amounting to KRW 1.6 million.
