A defendant shall be punished by a fine of 500,000 won.

When the defendant does not pay the above fine, 100,000 won.

Reasons

Punishment of the crime

The defendant is the user who is the representative director of the Co., Ltd. in Gangnam-gu Seoul and the first underground floor, who ordinarily employs 12 workers and operates a general restaurant business.

1. When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the Defendant had worked from March 16, 2017 to December 11, 2018 at the above workplace and had retired KRW 100,000 on October 10, 2018, the monthly wage of KRW 2,400,00 on November 11, 201, and KRW 3,751,612 on December 12, 201 without agreement on the extension of the due date between the parties.

2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after any cause for such payment occurred; and

Provided, That the date may be extended by mutual agreement between the parties in extenuating circumstances.

Nevertheless, the defendant is working from March 16, 2017 to December 11, 2018 at the above workplace.

The retirement allowance of retired workers D was not paid 4,19,656 won within 14 days from the date of retirement without any agreement between the parties on the extension of the due date.
