Defendant
A shall be punished by a fine of KRW 3,500,00, and by a fine of KRW 500,000, respectively.
The above fines are imposed by the Defendants.
Reasons
Punishment of the crime
1. The Defendant as the representative director of C, and (B) C, on December 11, 2014, entrusted the sale of cosmetics to E-free shops operated by D, and (B) D entered into a sales contract to manage and sell the supplied cosmetics and settle monthly profits.
On July 23, 2015, the Defendant: (a) supplied the Defendant under the above contract at E-duty shop operated by the victim (owner) D, who is located in Seoul, Gangnam-gu Seoul Metropolitan Government F Building 101; and (b) obstructed the victim’s exercise of rights on the sale of the above cosmetics, such as the cosmetic 197-T market price of the 11,934,000 won, including the cosmetic 197-T market price, which the victim displayed for the management and sale of the goods.
B. The Defendant interfered with business at the above time and place, on the ground that the victim G (the age of 49) who is a manager of E-free shop business, did not bring about the cosmetics displayed for sale without permission by the Defendant, thereby obstructing the Defendant’s performance of the duties of selling and operating the victim by avoiding disturbance for about five minutes, such as “Cyp chroe’s age : Cyp chp fyp fyp. fyp fyp fyp fyp fyp. fyp fyp fyp. fyp fyp fyp,”
2. Defendant B supplied to the Victim (State)D through (State)C in the name of the Defendant’s wife at the same date and time as the above 1.3, and obstructed the Victim’s exercise of rights on the sale of the above cosmetics by recklessly bringing about the sum of the 5,724,00 won, including the sum of the cosmetic interest 15 feet, the cosmetic 2nd class 15 feet, the cosmetic 2nd class 2nd class 19 feet, the beautiful first class 20 taxt, the beautiful first class 20 taxt, and the Saturdays 10 taxt.
