1. The Plaintiff is the owner of CMW 520D vehicles (hereinafter “instant vehicle”), and the Defendant is the driver of the vehicle consigned company.

원고는 2019. 2. 20.경 BMW 공식 수리업체인 D 주식회사 동대문서비스센터(이하 ‘동대문서비스센터’라고 한다)에 이 사건 차량의 보증수리를 의뢰하면서 차량 이동 서비스(픽업앤딜리버리 서비스)를 신청하였고, 위 동대문서비스센터는 이 사건 차량 수리 후 2019. 2. 21. 차량탁송업체를 통해 원고에게 이 사건 차량을 인도하였는데, 이 사건 차량의 인도를 담당한 차량탁송업체의 운전기사는 피고였다.

2. Determination

A. According to the facts found in the judgment as to the cause of the claim, it is reasonable to view that the accident in this case occurred due to the negligence of the defendant who operated the steering gear with no care, without examining the surroundings, and since the repair cost of the vehicle in this case caused by the accident in this case is recognized to amount to 4,472,820 won, barring any special circumstance, the defendant is liable to pay to the plaintiff the repair cost of the vehicle in this case and damages for delay thereof.

B. The main point of the Defendant’s argument regarding the Defendant’s assertion is that the front part of the left side of the instant vehicle is facing one time on the rubber material inducement.
