A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant of "2017 Highest 5446" is the representative of K accounting corporation located in Yeongdeungpo-gu Seoul Metropolitan Government J. 1122, who has employed 10 full-time workers and operated a certified accounting business.

1. When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, or other money or valuables within 14 days after the cause for such payment occurred;

On October 1, 2016, the Defendant worked as an employee for the foregoing business entity on April 30, 2017, but did not pay KRW 6,000,000,000 to L who retired on April 30, 2017 within 14 days from the date of retirement without any agreement between the parties on the extension of the payment deadline.

2. An employer who violates the Guarantee of Retirement Benefits of a worker shall pay a retirement allowance within fourteen days after the ground for such payment occurred, in case where the worker retires; and

On October 1, 2016, the Defendant served as an employee for the foregoing company on April 30, 2017, and did not pay 53,332,728 won in total for five employees, such as L, M, N,O, P, etc., within 14 days from the date of each retirement without any agreement between the parties on the extension of payment deadline, including retirement allowance of 20,440,981 won against L retired on April 30, 2017.

The defendant of the Yeongdeungpo-gu Seoul Metropolitan Government 1122 K Accounting Corporation's representative of the J Building 1122 is the user who has employed 10 full-time workers and has operated a certified accounting business.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred, and where the worker retires, the employer shall pay the worker a retirement allowance within 14 days after the cause for such payment occurred.

The Defendant worked in the said workplace from September 1, 2008 to July 17, 2016, and paid to Q Q from his/her retirement to 18,973,380 won in total, and retirement pay to Q from March 1, 2016 to July 2016.
