1. The plaintiff's claim is dismissed.

1. Basic facts

A. C subcontracted a reinforced concrete construction work among the new apartment construction work on the ground of Gangnam-si D, which was sub-subcontracted to E, and E re-subcontracted part of the aforementioned construction work to F.

The plaintiff lent or supplied a food house to F, and C was jointly and severally guaranteed the F's rental fee obligation around January 17, 2007.

B. The Plaintiff asserted that the Plaintiff did not receive KRW 463,437,400,00, and filed an application for provisional attachment against C on October 12, 2009, with the Chuncheon District Court Gangseo-gu 2009Kadan1613, and C agreed to pay KRW 463,437,400,00 to the Plaintiff in the event that the Plaintiff did not pay KRW 300,000,000 to the Plaintiff by November 20, 2009, upon preparing the certificate of promissory notes with a face value of KRW 300,000,000,000,000,000.

C. In order for C to not pay KRW 300 million, the Plaintiff filed a lawsuit claiming construction cost as the Gangnam District Court Branch of Chuncheon Branch of 2010 Gohap4694.

From the appellate court [Seoul High Court (Chuncheon) 201Na2338] to August 29, 2012, the judgment ordering C to pay the Plaintiff the remainder of 332,351,089 won, excluding the amount of the Plaintiff’s creditors G, who received the seizure and collection order, and damages for delay calculated from November 18, 2010, which became final and conclusive on December 14, 2012.
