The prosecutor's appeal is dismissed.

1. According to the evidence submitted by the Prosecutor, the facts charged in this case can be fully recognized, and the judgment of the court below which acquitted the Defendant of the facts charged in this case is erroneous in the misapprehension of facts.

2. The summary of the facts charged was around 07:00 on September 20, 201, the Defendant: (a) tried to find the victim’s cell phone located in the Busan-gu Busan-gu Busan-do Busan-si, and her chest was sypted once to commit an indecent act against the victim by force; (b) on April 4, 2012, at around 17:50:33, the Defendant called “a dypology expert, one defect, and one money reduction”; (c) called “a dypology expert, one defect, and one money reduction”; and (d) told the victim’s cell phone repeatedly via the victim’s cell phone over a total of 29 times from that time to July 4, 2012; and (d) made an obscene speech to the victim three times in total to cause fear or apprehensions to the victim.

3. As to the judgment, the court below made a statement to the effect that ① the victim had the attitude of disregarding the defendant from time to time during the examination of witness, ② the contents of the ice distance in the examination of witness are friendly to the defendant, ② the defendant's breath in the course of the examination of witness, ② the defendant's breath in the course of the examination of witness, ② the victim's breath in the course of the defendant's breath, and prevented the defendant, ③ the defendant's breath in the course of the examination of witness, ③ the defendant's oral statement to the effect that the statement was made before the defendant's withdrawal from the examination of witness to the effect that the statement was made that the statement was made in front of the defendant who want to leave the examination of witness, ④ the defendant's breath in the pre-examination of witness, and the relation between the victim and the defendant was formed in a vertical subordinate relationship. ⑤ The victim of indecent act by compulsion is the perpetrator.
