A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On January 24, 2018, the Defendant driving a car B without obtaining a driver’s license in the section of approximately 800 meters from the “Taeaea dan dan Garan,” located in the center of Taean-gun, Taean-gun, Taean-gun, Chungcheongnam-gun, Taean-gun, to the 7-1 west and its vicinity, without obtaining a driver’s license.

2. 도로 교통법위반( 음주 측정거부) 피고인은 2018. 1. 24. 02:00 경 충남 태안군 원 이로 7-1에 있는 태안 여고 앞 도로에서 시동을 켠 채 잠을 자고 있다가, 같은 날 03:54 경 112 신고를 받고 출동한 태안경찰서 C 지구대 순경 D으로부터 피고인의 입에서 술 냄새가 심하게 나는 등 술에 취한 상태에서 운전하였을 것이라는 상당한 이유가 있어 음주측정기에 입김을 불어 넣는 방법으로 음주 측정에 응할 것을 요구 받았음에도 그 때부터 같은 날 04:05 경까지 3회에 걸친 경찰공무원의 음주 측정요구에 정당한 사유 없이 불응하였다.

The reason for sentencing under Article 62-2 of the Social Service Order Act is the time interval between the criminal records of this case and the criminal records of the same kind, reflects the defendant's age, environment, sexual conduct, motive, means and consequence of the crime, and all of the sentencing factors indicated in the arguments of this case, such as the circumstances after the crime, shall be determined as ordered.
