The defendant shall be innocent.

1. The Defendant is engaged in the business of driving Crocketing taxi.

On August 20, 2015, the Defendant driven the above vehicle at around 05:50 on August 20, 2015, and proceeded with the intersection in front of the 110 Young-gu Seoul Metropolitan Government Boporo, Bopo-ro, Bopo-ro, 110, the New Tri-gu, Bopo-ro.

Since the location is an intersection where signal lights are installed, a person engaged in driving of a motor vehicle has a duty of care to safely pass the intersection according to the signals.

Nevertheless, the defendant neglected this and proceeded as it was due to negligence, disregarding that the vehicle progress signal is changed to a stop signal, and the victim D (the age of 49) who applied to the left-hand turn according to the vehicle progress signal from the front part of the vehicle operated by the victim D (the age of 49) in the front part of the defendant's vehicle.

Ultimately, the Defendant suffered injury in need of approximately one day’s treatment to F (n, 41 years of age) who was on board the Defendant’s vehicle through occupational negligence above.

2. According to the evidence submitted by the prosecutor, it is recognized that the defendant caused a traffic accident shocking village buses through occupational negligence, such as the date and time stated in the facts charged.

However, even according to the evidence submitted by the prosecutor, the taxi passenger F was transferred to the emergency room of G Hospital on August 20, 2015, which was the date of the accident and received outpatient treatment.

Since F is not fully submitted with a medical certificate, opinion opinion, etc. that shows the degree of specific injury or treatment period suffered by the above accident, there is no proof of injury among the facts charged.

On the other hand, annoying person who cannot be assessed as "injury" as stipulated in Article 257 (1) of the Criminal Act is established in cases where it is difficult to view that the health condition was infringed due to the lack of treatment as an agent.
