A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around March 28, 2011, the Defendant conspiredd to receive insurance money from an insurance company after intentionally causing a traffic accident with C, D, E and intentionally at a cultural park located in Yeonsu-gu Incheon Metropolitan City, Yeonsu-gu, Incheon, and then accepting as if a traffic accident occurred.
At around 17:20 on March 30, 201, the Defendant was recruited in the vicinity of the Incheon Middle School located in the same Dong, E, D, and C, while driving a G car, caused a traffic accident in which the Defendant intentionally gets back of the G car with the front part of the said car by intentionally driving the G car, and the Defendant, E, and D were hospitalized at the hospital, and C received a more K car accident insurance policy.
The Defendant, in collusion with E, C, and D on April 11, 2014, filed a claim for the payment of insurance proceeds with the victim company, E, C, and D, thereby deceiving the victim company’s name-free employees, and the Defendant was given a total of KRW 3,576,760 from April 1, 2011 to April 5, 201 as stated in the attached crime list (1).
2. On April 3, 2011, the Defendant conspiredd with H and E to receive insurance proceeds from an insurance company after causing a traffic accident with H, E and intentionally in the vicinity of the training-dong, Yeonsu-gu, Incheon, and resulting in a traffic accident.
At around 22:00 on April 14, 201, the Defendant conspiredd as above in the vicinity of Yeonsu-gu Incheon Metropolitan City I, the Defendant: (a) driven a bicycle after riding the bicycle; (b) caused a traffic accident by intentionally driving the J-based bicycle; and (c) the Defendant and E were hospitalized in the hospital while driving the J-based bicycle as if they were seriously friendly due to a sudden accident; and (d) H was insured by the victim’s Hyundai Marine Fire Insurance (State).
