The judgment of the court below is reversed.

The defendant shall be innocent.

1. The gist of the grounds for appeal is that the judgment of the court below which found the defendant guilty of the facts charged is erroneous in misconception of facts, although the defendant did not have any or no injury to the victim.

2. Summary of the facts charged and the judgment of the court below

A. The summary of the facts charged is that the Defendant is a person operating a c restaurant in the Eunpyeong-gu Seoul Metropolitan Government 240 NC department store 9th floor of the NC department store, and the victim D is a person operating the e-cafeteria. On October 5, 2012, the Defendant: (a) around 23:00, the Defendant inflicted an injury on the victim, i.e., e., e., the victim’s cryp within the Pdcot; (b) the victim’s cryp in order to move the cryp to his cryp; and (c) the victim’s cryp in one hand cryp to the left-hand part of the blue cryp with the victim’s cryp and the victim’s cryp in need of treatment for approximately two weeks.

3. Judgment of the court below

A. However, in light of the following circumstances, the evidence submitted by both parties and the record, which was admitted by the court below, is difficult to recognize credibility or the evidence alone, and there is no other evidence to prove this differently.

(1) The victim stated in the police that "the defendant carried the chest in one hand and carried the chest in the left side with the elbow." The court below stated in the court below that "the defendant carried the breast part by hand and carried the chest in the elbow with the breast part by hand.
