1. Basic facts

A. The Plaintiff is an insurer who has concluded an automobile insurance contract with respect to a vehicle A (hereinafter “Plaintiff”) and the Defendant is an insurer who has concluded an automobile insurance contract with respect to B B B (hereinafter “Defendant vehicle”).

B. On December 9, 2016, there was an accident that conflicts between the front part of the Plaintiff’s vehicle located at the front intersection in the Nam-gu Seoul metropolitan area and the front part of the Defendant’s vehicle that was bypassing the front part of the Plaintiff’s vehicle, which was located at the front intersection in the Nam-gu Gwangju metropolitan area, and the site map of the accident and the situation of the accident are as shown in

C. On December 15, 2016, the Plaintiff paid KRW 610,00 to E, 1,780,400 to F agency, KRW 36,300 to G, and KRW 77,700 to H agency (i.e., KRW 610,780, KRW 36,300 to KRW 36,30,000). (d) When the Plaintiff intends to make a right-hand at the intersection, the driver of any motor vehicle must make a right-hand side of the road in advance while driving along the right-hand side of the road.

In such cases, the driver of a bypassing motor vehicle shall stop in accordance with the new subparagraph or take care of pedestrians or bicycles.

(1) The driver of any motor vehicle who intends to drive a motor vehicle into the intersection where traffic is not controlled shall yield the right of way to other motor vehicles, when other motor vehicles are already traveling through the intersection.

(2) The driver of any motor vehicle who intends to drive a motor vehicle into an intersection where traffic is not controlled, shall slowly drive the motor vehicle, if the width of the intersection is wider than that of the road on which the motor vehicle is traveling, and when any other motor vehicle intends to drive a motor vehicle into the intersection from a road with a wide width, he/she shall yield the right

(3) The driver of any motor vehicle who intends to enter the intersection where traffic is not controlled shall yield the right of way to the motor vehicle on the right side.
