A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. On September 2013, the Defendant: (a) at the house of the Defendant’s office located in Heung-gu and B 102 in Cheongdong-gu, Chungcheongnam-gu; (b) at the upper house, the Defendant inducedd the victim D (the age of 86) who was living in the upper house to drink in the body of the Defendant and let the victim take the house of the Defendant; and (c) the Defendant committed an indecent act by force by force by force by taking out the victim’s chests only after he was discharged from his clothes and her clothes.
2. At around 11:30 on November 27, 2013, the Defendant attempted rape, at the place under the above paragraph (1) of the same Article, the Defendant: (a) walked the victim E (the 48-year old-old-old-age-old-age-old-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-her-child-her-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-and-child-child-child-child-child-child-child-and-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-her-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child-child.
3. The Defendant, in violation of the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (obscenity using a communication medium) tried to rape the victim as described in the above paragraph (2), but, after attempted rape, had the victim take a phone at the victim’s home for the purpose of meeting his/her sexual desire at around 14:34 of the same day and reached the victim’s speech that may cause sexual humiliation or aversion with the victim by using a communication medium, such as “whether he/she opened the door, view hole, or otherwise.”
