Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

1. The criminal defendant was operated jointly with B in 2005, and around 2009, the Daegu District Court became aware of B's resident registration number under the criminal trial with B.

The defendant, using the resident registration number B (C), was killed to receive insurance benefits from the National Health Insurance Corporation.

On May 16, 2018, the Defendant, at the Seongdong-gu Seoul building and the 3rd floor “AD Council member,” provided the above B’s resident registration number in order to receive general outpatient treatment, and was provided the said hospital’s outpatient treatment from the doctor E.

As such, the Defendant, after deceiving a doctor E and being treated as B, paid in cash only KRW 45 million, and 10,810 remaining 10,000,000 from May 16, 2018 to February 16, 2019, by allowing the National Health Insurance Corporation, which is the victim, to pay to the above hospital, was taking property profits equivalent to 302,860 won all over 29 times, such as the statement in the list of crimes.

2. No person who violates the National Health Insurance Act shall receive insurance benefits by fraud or other improper means;

Nevertheless, the Defendant received insurance benefits by illegal means from the National Health Insurance Corporation, which is a victim, as described in the above paragraph (1).

3. No person who violates the Resident Registration Act shall unlawfully use another person’s resident registration number.

Nevertheless, around May 16, 2018, the Defendant thought on May 2, 2018, that he would receive medical treatment using B’s resident registration number (C) in Seongdong-gu Seoul building and the third floor “E” building.

As indicated in the list of crimes in paragraph (1) above, the Defendant unlawfully used another’s resident registration number by using B’s resident registration number from May 16, 2018 to February 16, 2019 as if the Defendant was B.
