1. The Defendant shall pay to the Plaintiff KRW 117,39,526 as well as 20% per annum from November 17, 2015 to the date of full payment.

No dispute exists between the parties, or comprehensively taking account of the overall purport of the statement of evidence No. 1 and the pleading, the Plaintiff retired from office as an employee from the Southern concrete Co., Ltd. from March 26, 2012 to November 2, 2015. The Plaintiff was not paid 129,99,526 won of overdue wages and retirement pay from December 2, 2014 to November 2, 2015. The Plaintiff received 12,60,000 won as substitute payment on April 1, 2016, and the Plaintiff received 12,60,000 won as substitute payment on December 9, 2015.

If the facts are identical, the defendant is obligated to pay to the plaintiff 117,99,526 won and the amount equivalent to 20% per annum from November 17, 2015 to the full payment date of 14 days after the date of the plaintiff's retirement.

Although the defendant asserts that the above overdue wages and retirement allowances are rehabilitation claims, there is no evidence to acknowledge the defendant's assertion.

It is so decided as per Disposition for the above reasons.
