A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above sentence shall be suspended for a period of one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Except as otherwise expressly provided for in any other Act, no electronic card used to issue instructions for transactions or to secure the authenticity and accuracy of the details of transactions with users and information on electronic financial transactions shall be transferred to any third party, such as a password necessary for the use of such card and information.
1. On October 21, 2013, the Defendant, without confirming the specific personal information, office location, etc. of a person who was not his/her name, transferred the physical card to his/her name in his/her name, via Kwikset’s service in front of a mutual influorial restaurant located in Gangnam-gu Seoul, Gangnam-gu, Seoul, via Kwikset’s service, three copies of the physical card linked to C, D, and E, respectively, to Kwikset’s name.
2. On January 2, 2014, the Defendant, without confirming the specific personal information, office location, etc. of a person who was not his/her name, transferred the physical card, etc., which is linked to the national bank account (Account Number:F) in his/her name in the name of Kwikset, through Kwikset’s service, from the trade name in French Seocho-gu Seoul, Seocho-gu, Seoul, without setting the specific time, place, and method for receiving the return of the physical card.
3. On January 9, 2014, the Defendant, without confirming the specific personal information, location of office, etc. of a person who was not his/her name, transferred three copies, etc. of the physical card linked to G, H, and I, to a person who was named in his/her name, via Kwikset’s service at the front of the mutual unclaimed restaurant located in Seocho-gu Seoul Metropolitan Government Seocho-gu, Seoul, as his/her name, via Kwikset’s service.
4. The defendant does not confirm his name, the specific personal information, the location of his office, etc., of the wounded.
