Defendant shall be punished by imprisonment for a term of one year and six months.

Of the facts charged in the instant case, it is against the Defendant’s assault (Seoul High Court Order 3987, 2018).

Punishment of the crime

[2018 Highest 2976] The Defendant was sentenced to eight months of imprisonment for a special intimidation, etc. at the Seoul Northern District Court on December 15, 2016, and completed the execution of the sentence at the Jung Eup prison on June 26, 2017. On September 13, 2018, the Seoul Eastern District Court was sentenced to six months of imprisonment for special bodily injury, etc. and the judgment on September 17, 2018 became final and conclusive.

Criminal facts

1. On June 30, 2018, from around 15:40 to around 16:00, the Defendant: “E” mobile phone store operated by the victim D (52 aged) located in Dongdaemun-gu Seoul, Dongdaemun-gu, without any justifiable reason, to the victim and its customers who were in the place, without reason, during the state of alcohol.

“Along with the Majority’s view, customers who had been able to take care of 20 minutes were able to take out by avoiding the disturbance as described in paragraph 2.

Accordingly, the defendant interfered with the victim's mobile phone sales business by force.

2. 특수 상해 피고인은 제 1 항 기재 일시, 장소에서 제 1 항 기재와 같이 욕설을 하여 위 피해 자로부터 항의를 받자 오른쪽 손바닥으로 피해자의 뒤통수 부위를 1회 때리고 주먹으로 피해자의 왼쪽 뺨 부위를 1회 때려, 이에 놀란 피해 자가 피고인을 밀어내자 다리로 피해자의 다리를 걸어 그곳에 있던 소파 위로 넘어뜨린 후 피해자의 몸 위에 올라 타 주먹으로 피해자의 얼굴 부위를 수회 때리고 이마로 피해자의 얼굴을 들이받았으며, “ 죽여 버리겠다 ”라고 말하면서 오른손 엄지손가락으로 피해자의 왼쪽 눈 부위를 강하게 누르고 위 소파 옆 정수기 위에 있던 위험한 물건인 스테인리스 컵을 집어 들고 피해자의 얼굴 부위를 수회 내리치고 그 컵에 있던 찻숟가락을 쥐고 피해자의 얼굴 부위를 수회 내리찍었다.

The defendant is thereby dangerous.
