Reasons
Punishment of the crime
1. Defendant A and Defendant B were appointed as the representative director from November 8, 2016 to June 13, 2017 from Co., Ltd. established for the purpose of manufacturing and selling health foods to Defendant A, and Defendant B was appointed from Co., Ltd. to Defendant A’s former representative director, and was explained for business for Defendant C as the sales supervisor.
Multi-stage distributors shall be registered with the Fair Trade Commission or the Mayor/Do Governor, as prescribed by Presidential Decree.
Nevertheless, the Defendants, without being registered, conspired to have the profits generated from the establishment, management, and operation of a multi-level marketing organization that sells health food through the corporation of the above C, without being registered.
From November 23, 2016 to May 15, 2017, the Defendants purchased 1 unit of health functional foods to many and unspecified persons, such as H, such as the Jung-gu Office in Daejeon, the office room in the second floor, the Jeonjin-gu G, and the Jeonju Center in the Jeonjin-gu, and the Jeonju Center in 202, and purchased 2 unit under the bottom of the members, 4.20,000 won as allowances, and other recommended allowances, promotion allowances, co-ownership allowances, and class allowances were paid, and sold to the branch, etc.
around April 6, 2017, the Defendants sold “I” to H to 60,00 won per unit of “I,” and “I” to H around April 24, 2017, and “K” to 1980,000 won per three old units of “K” (60,000 won in the name of H; 660,000 won in the name of H; 660,000 won in the name of H; 660,000 won in the name of M where the relationship is unknown); and from around May 2, 2017 to May 2, 2017, the Defendants received a total of KRW 419,190 in payment of KRW 19,00 in the name of sales supervisor from around November 23, 2016 to May 24, 2017; 300,000 in the name of members (hereinafter “K”); and 200,000 won in the name of members.
