Defendant shall be punished by imprisonment without prison labor for eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is a person who is engaged in driving D class D and III 1 ton cargo vehicles registered in the name of the land C.

피고인은 2018. 5. 30. 경 서울 관악구 신림동 길 13에 있는 일방통행 이면도로에서 위 화물차를 운전하여 동대문 엽기 떡볶이 식당 방면에서 신림동 주민센터 방면으로 역 주행하여 진행하였다.

위 이면도로는 신림동 주민센터 방면에서 동대문 엽기 떡볶이 식당 방면으로 일방통행만 할 수 있는 도로로, 그 도로 상에 위와 같은 방향의 일방통행 표지 및 반대 방향으로 진입을 금지하는 표지가 설치된 장소이므로, 이러한 경우 피고인은 자동차 운전업무에 종사하는 사람으로서 위 교통 표지에 따라 위 이면도로를 일방통행의 역방향으로 진행하지 아니 되고, 일방통행 방향을 준수하여 진행하는 다른 차량 등과 사고가 발생하지 아니하도록 안전하게 운전해야 할 주의의무가 있다.

Nevertheless, the defendant did not comply with the direction indicated by the above one-way traffic sign, neglected the duty to see the front side, and went to the left from the "road of the fashion culture" side, and entered the above side of the victim E ( South, 35 years old) who was driving on the above side and did not avoid the driver's bicycle, and received the part on the left side of the bicycle of the motor device in front of the above awning-III cargo vehicle.

Ultimately, the Defendant suffered approximately 10 weeks of medical treatment from the victim due to such occupational division and room.
