1. Basic facts

가. 쌍용자동차 주식회사는 B에 대하여 원금 20,054,129원의 자동차(건설기계) 할부금 보증채권을 가지고 있었는데, 2005. 7. 14.경 위 채권을 윈윈쌍용제이차대부 유한회사에 양도하였고 그 무렵 B에게 채권양도통지를 하였다.

나. 윈윈쌍용제이차대부 유한회사는 서울동부지방법원 2009가단54394호로 B을 상대로 위 양수금채권의 지급을 구하는 소를 제기하여 2009. 11. 30. ‘B은 윈윈쌍용제이차대부 유한회사에게 82,519,331원 및 그 중 20,054,129원에 대하여 2009. 9. 10.부터 다 갚는 날까지 연 20%의 비율로 계산한 돈을 지급하라’는 판결을 선고받았고, 위 판결은 그 무렵 확정되었다.

다. 윈윈쌍용제이차대부 유한회사의 위 양수금채권은 한울대부자산관리 주식회사, 천일에셋대부 주식회사, 시데코인베스트먼트 주식회사를 거쳐 최종적으로 원고에게 영도되었고, 원고는 2016. 1. 13.경 B에게 채권양도통지를 하였다. 라.
