A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2013. 5. 23. 23:32경 혈중알콜농도 0.121%의 술에 취한 상태에서 김천시 부곡동에 있는 신풍철물 앞 편도 2차로에 주차해 두었던 B K5 승용차를 업무로써 운전하여 출발하게 되었는바, 주차하였다가 출발하는 경우 진로전방 및 좌우를 잘 살펴야 하고, 차선을 변경할 경우에는 방향지시등을 작동하여 그 진로변경을 예고하고 전후좌우의 교통상황을 잘 살피면서 안전하게 운전하여야 할 의무가 있음에도 불구하고 술에 취하여 이를 게을리 한 채 시동을 걸고 출발하자마자 핸들을 꺽어 좌측으로 차선을 변경한 과실로 위 도로 1차로에서 진행하고 있던 피해자 C(37세) 운전의 D NF소나타 승용차의 우측 문짝 부분을 피고인 차량의 앞 범퍼 부분으로 들이받아 피해자로 하여금 약 2주간의 치료가 필요한 뇌진탕 등의 상해를 입게 함과 동시에 피해자 차량을 수리비 1,523,766원 상당이 들게 할 정도로 손괴하고도 즉시 정차하여 피해자를 구조하는 등의 필요한 조치를 취하지 아니하고 그대로 도주하였다.
