A Imprisonment for three years, and Defendant B shall be punished by imprisonment for four months, respectively.
However, as to Defendant B, the same shall apply for a period of one year.
Reasons
Punishment of the crime
[criminal history] Defendant A was sentenced to two years of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul Western District Court on October 28, 2010. On January 17, 2013, Defendant A was sentenced to ten months of imprisonment with prison labor for larceny, etc. at the Seoul Eastern District Court on June 12, 2014. Defendant A was sentenced to one year and six months of imprisonment with prison labor for a crime of violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Seoul East East District Court on June 12, 2014. On January 14, 2016, Defendant A completed the execution of the sentence at the Gwangju East District Court on January 27, 2017.
[Criminal facts]
1. Defendant A
A. On January 26, 2018, at around 14:00, the Defendant: (a) removed one of the crime prevention window installed on the corridor window in his/her hand in order to steals the property; (b) opened a window not corrected by the crepan; and (c) intruded the victim’s house; (d) opened a window in the crepan; and (e) went into the victim’s house; and (e) opened a crepan; and (e) opened a crepan; and (e) opened a crepan in a foreign currency, which is the victim’s ownership on a paper bag that was left on the main container; and (f)46,910 won at a small line; and (f) took place at the market price of the victim’s tax exemption amounting to KRW 746,910; and (f) 1,387,762 won at the market price; and (f) carried out a theft belt with 200 U.K. gold belt.
B.
