Punishment of the crime

[criminal power] On January 19, 2018, the Defendant was sentenced to two years of imprisonment with prison labor for the crime of destroying and damaging special objects in the support of the Incheon District Court. On August 27, 2019, the Defendant completed the execution of the sentence in the Eunpyeong House Housing Site.

【Criminal Facts】

1. On January 22, 2020, at around 01:30, the Defendant obstructed the victim’s main business by force of about 10 minutes by preventing other customers from entering the said main shop, and obstructing the victim’s main business by force by force of about 10 minutes, while drunkly drinking one person and drinking at the four main stations of D, which are operated by the victim C.

2. 재물손괴 피고인은 제1항 기재 일시, 장소에서 제1항 기재와 같은 방법으로 피해자 소유인 시가 합계 33,000원 상당의 양주잔 11개, 시가 합계 12,000원 상당의 맥주잔 4개, 시가 합계 8,000원 상당의 샷잔 4개, 시가 합계 200,000원 상당의 마이크 2개를 벽과 바닥을 향해 집어던져 파손하고, 깨진 유리 파편이 있는 곳으로 시가 합계 400,000원 상당의 소파 방석 2개를 집어던져 소파 방석 천이 찢어지도록 하여 피해자의 재물을 손괴하였다.

3. 공용물건손상 피고인은 제1항과 같은 날 02:00경 C의 신고를 받고 출동한 경주경찰서 동천파출소 소속 경찰관으로부터 귀가 권유를 받고 위 주점 밖으로 나와 경찰관에게 “너거는 오늘 내한테 다 죽었어. 씨발 짭새 새끼야. 오늘 내한테 한번 죽어볼래.”라고 말하며 위 주점 앞에 주차되어 있던 E 순찰차의 조수석 앞 범퍼 부분을 발로 차 공용물건인 순찰차를 수리비 541,231원 상당이 들 정도로 손상하였다.
