1. The defendant shall be the plaintiff.

A. Of the size of 188 square meters on Seongbuk-gu Seoul road B, indication of the attached drawing 49, 50, 51, 52, 53, 62, 63, 55, 56.

1. Basic facts

A. On July 19, 1971, the Plaintiff purchased from D a house of 116 square meters in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, and 10 square meters in G (hereinafter “F”) and two-storys in its ground (hereinafter “instant house”), and completed the registration of ownership transfer on July 21, 1971.

B. The instant housing was approved for use on June 2, 1969. The Plaintiff extended the part of 1st floor to 9.19 square meters on or around June 4, 198. In other words, around June 16, 198, the Plaintiff extended the underground floor to 26.6 square meters on or around June 16, 198. Meanwhile, on May 25, 198, the instant housing was combined with the 10 square meters on or around May 25, 198, and divided the 14 square meters out of the adjacent H site into 14 square meters on or around December 18, 198, and the E site area became 140 square meters by combining the E site into the E site on or around March 29, 191.

C. On November 25, 200, the Plaintiff donated the instant house of 140 square meters and its ground to his wife, and completed the registration of ownership transfer in the J on November 27, 2000. On May 17, 2012, the Plaintiff terminated the said gift agreement and restored the said registration to its original state by cancelling the said registration of ownership transfer.

The Defendant is the owner of B-road B (hereinafter “instant one”) and C-road 20 square meters (hereinafter “instant two roads”) adjacent to E large scale 140 square meters.

The instant one road was newly registered by the Defendant as a road on the land cadastre on December 30, 1954, and was divided on January 23, 2003 from K 4,886 square meters, which completed the registration of preservation of ownership on February 16, 1990. The instant two roads were divided on December 20, 1963 from the L site, which completed the registration of ownership transfer on January 9, 1963, which was divided on December 12, 1969, and the land category was changed to the road on September 1, 1986.

E. Of the instant roads 1, the parts on the “vid” portion and the part on the “A” portion connected in sequence with each point of 49, 50, 51, 52, 53, 62, 63, 55, 56, 38, 57, 7, 67, 55, 4, and 49, among the instant roads 1, are combined with each point of 53, 54, 55, 63, 62, and 53, among the two roads of this case, the part on the “A” and the “A” portion on the instant dispute.
