A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

1. The Defendant is a person who served as the president of the victim D clan from January 2009 to December 2014.

A. On July 6, 2010, the Defendant deposited KRW 30 million out of the membership fees of the same clan owned by the said clan to the National Bank Account (Account Number E) in the name of the Defendant and embezzled the said clan by voluntarily consuming the said KRW 30 million from the above passbook around the 9th of the same month and then consuming it for private purposes.

B. On January 5, 2012, the Defendant: (a) completed the registration of the transfer of shares in the name of the Defendant with the trust of 2/3 of the FF volume 496 square meters in Incheon, Incheon, G, G, 425 square meters; (b) 59/3 of the amount of 190 square meters in the name of 190 square meters in the name of the Defendant; and (c) was kept in the custody of the victim’s clan for the said clan after having completed the registration under the name of the Defendant; (b) in the name of the Defendant, the Defendant: (a) had the intent to borrow money from the bond company as collateral; and (c) had the Defendant completed the registration of the establishment of the right to collateral security with the amount of 5,659,000 square meters in the amount of 49 square meters in the amount of 190 square meters in the amount of 190 square meters in the name of the said clan; and (d) has embezzled the Defendant’s above shares

2. On October 27, 201, the Defendant, at the Defendant’s home located in Kimpo-si, Kimpo-si, embezzled a clan membership fee as set forth in the above 1-A, and, on October 27, 201, submitted to the general meeting of a clan to indicate that the maturity of one-year term deposits has not yet arrived, the Defendant, without authority, deleted the portion indicated as “the transaction date: July 9, 2010; the cancellation of the transaction classification; the current balance:05” from another passbook in the Defendant’s name by inserting the part as “2010705” from the said passbook to the “2010706,” and then inserting it by inserting it to the “2010706,” the head of a passbook in the name of the Defendant.
