Defendant

A shall be punished by imprisonment without prison labor for ten months, and by imprisonment without prison labor for six months, respectively.

Punishment of the crime

1. Defendant A is a person who is engaged in driving of Category C New Freight Truck trucks.

On August 18, 2012, the Defendant, around 08:39, proceeded at the speed of about 60 km from the 2-lane to the military documents of the same military, in the direction of the Simmnae Sports Center in Young-gun, Young-gun, Young-gu.

At this point, there was a duty of care to check whether there is another vehicle that is temporarily stopped before the speed is reduced and entry into the intersection and to prevent the accident by driving safely.

Nevertheless, the Defendant neglected to do so and found at a later time the D Launa car of B driving that entered the intersection between the two-lanes from the right-hand side of the running lane and the two-lanes from the office of education on the right-hand side of the passing lane, and operated it rapidly, but did not avoid it, and received the back part of the driving seat of the said car as the front-hand part of the said cargo vehicle.

Ultimately, the Defendant caused the death of the victim E (n, 42 years of age) who is a passenger of the said passenger car due to the foregoing occupational negligence, from G Hospital located in Youngnam-gun F on August 18, 2012, around 09:45, to the death of the victim E (n, 42 years of age).

2. Defendant B is a person who is engaged in the operation of Drocketing and passenger cars.

On August 18, 2012, the Defendant, around 08:39, proceeded at the speed of 1:00 square meters from the direction of the Yongaman Office of Education, along with a long-ranged road in the front of the Seocho-gu, Yongaman-gun, Young-gun.

At this point, there is a private street intersection and a red flickering on and off, so it is confirmed whether there is another vehicle that crosses by temporarily stopping before reducing the speed and entering the intersection.
