A defendant shall be punished by imprisonment for one year.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From October 2012, the Defendant: (a) from around 2012 to around Busan, a person who operated a mobile phone store with the trade name “D” in Busan, Busan, a person having difficulty in management due to the decline in sales; (b) voluntarily prepared an application for subscription to a mobile phone using the personal information of the customer collected by opening the mobile phone through the opening of the mobile phone; and (c) received it from a superior agency and received it from a new mobile phone; and (d) intended to dispose of it as used goods.

1. Even where a personal information manager has collected personal information with the consent of a subject of information, he/she shall not use the personal information beyond the scope of the purpose of collection;

Nevertheless, around February 28, 2013, the Defendant: (a) prepared a resident registration number using the resident registration number that he/she became aware of in the course of opening the cell phone to the victim E, who is an existing customer; and (b) stored it in a scanner; and (c) submitted it to the Kocom employees in a computer system; and (d) used the resident registration number of the personal information, which is 14 times in total, from the above date to September 30, 2014 in the same manner, without the consent of the victims, as shown in the list of crimes in the attached Form.

Accordingly, the defendant used personal information beyond the scope of collection purpose without the consent of the subject of information.

2. The Defendant, at the date and time specified in paragraph (1), and at the place specified in the foregoing E’s resident registration number to open a mobile phone, and without authority, entered information about E in the customer name, resident registration number, and applicant column of the mobile phone with the intent to exercise the right to use the mobile phone, and sign and forge the document, and submit the file which can be found in the document in question to the employees of our Telecom Co., Ltd., who may know of the fact, to the extent that the document was duly formed, and submit it to the said employees of our Telecom.
