Criminal facts

No person shall infringe on any property right protected by the property right of author by means of reproduction, performance, public transmission, exhibition, distribution, lending, or the method of preparing derivative works.

Nevertheless, the defendant, however, shall:

1. On February 24, 2020, by accessing the Internet file sharing website D using a computer at the website’s own residence, and receiving “G”, which is a video product with the right of reproduction, transmission, and distribution from F Co., Ltd., a video product with the right of reproduction, transmission, and distribution at the F Co., Ltd., then infringing the complainant’s property right by advertising it to D, the same website;

2. On May 20, 2020, by accessing the Internet file sharing website D using a computer at the location of the north-gu B lending C on May 20, 2020, received “I”, a video product holding the right of reproduction, transmission, and distribution at H, and then infringed on the complainant’s author’s property right by advertising it to D, the same website;

3. On May 21, 2020, by accessing the Internet file sharing site J by using a computer at the location of the north-gu B lending C, North Korea-si, and received “I”, a video product with the right of reproduction, transmission, and distribution at H, a corporation, from the Internet file sharing site J, and then infringed the complainant’s property right by putting it up to J, which is the same site.
