A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
The Defendant served as the Director General of Gangseo-gu Seoul Metropolitan Government Office of Office of Office of Office Management for about eight years from May 2003 to the Habman from August 201, 201. The Defendant is a person who has been engaged in general fund management and building facility management duties, including general management expenses and public charges, from the total of 69 households of the above officetels, including the representative D of the council of representative representatives of the council of occupants' representatives, the victims.
1. The Defendant: (a) transferred the general management expenses of officetels to a new bank account in the name of the office of the management of officetels and kept for the victims, from the occupants of the above 69 households; (b) transferred KRW 100,000 from the above office of the management of officetels to the new bank account in the name of the Defendant’s name on January 7, 2004; and (c) transferred the total amount of KRW 18,890,000 to the above account in the name of the Defendant from around that time to April 16, 2010, and arbitrarily used it.
2. The Defendant entered into a contract for the installation of a base station with a mobile carrier on the instant officetel, and received the rent from the said officetel to the account in the name of the management office and kept it for the victims, despite the fact that the Defendant: (a) around October 11, 2005, received and arbitrarily used the rent of KRW 4.922,00 from the said officetel mobile operator to the new bank account in the name of the Defendant; and (b) from around that time to March 18, 201, received and used the total sum of KRW 17,761,00 in total on 17 occasions as indicated in the crime list 2 (Embezzlement of the rent of the mobile communications base station) from around that time to March 18, 201.
Accordingly, the Defendant embezzled the sum of KRW 180,650 million.
