1. The Plaintiff (Counterclaim Defendant) paid KRW 165,067,200 to the Defendant (Counterclaim Plaintiff) and its related amount from April 27, 2017 to March 8, 2018.
Reasons
1. Basic facts
A. The Plaintiff (former: C) is a company established for the purpose of the manufacture of energy-saving machinery and the installation and construction business, etc., and the Defendant is a company established for the purpose of the construction business of machinery and equipment, etc., and D religious organization E company (hereinafter “E company”) is a temple located in F at the time of public offering.
B. On February 27, 2014, the Defendant concluded a contract with E company and the Defendant to manufacture a set pumps, which are energy-saving equipment, and to install them in E company (hereinafter “instant contract for manufacture and installation”).
C. On April 24, 2014, the Defendant entered into a contract with the Plaintiff (including the value-added tax) on the contract amount of KRW 90,22 million (hereinafter “instant contract”). D.
