한편 원고의 2014. 3. 21.자 준비서면 26쪽과 이 사건 전자기록의 증거목록에는 갑 13호증의 1의 증거표목이 「‘L‘ 앨범의 원고 아리랑」등으로 기재되어 있으나, 위 음원파일을 실제로 윈도우 미디어 플레이어에서 재생하면 제목이 “M"로 표시되는 점, 그 연주 길이도 5:40로 ‘F’의 12번 트랙과 같은 점, 위 음원파일은 기타 듀엣 연주곡인데, 원고 또한 ‘F’의 원고 아리랑이 기타 듀엣 연주곡이고 ‘L’ 앨범의 아리랑은 드럼 등이 편성된 밴드 연주곡임을 밝히고 있는 점(같은 준비서면 15쪽 각주 2번) 등에 비추어 보면, 위 증거표목의 기재는 오기임이 분명하다.
