A defendant shall be punished by imprisonment for a term of one year and two months.

An application filed by an applicant for compensation shall be dismissed.

Punishment of the crime

On July 21, 2017, the Defendant sentenced the Incheon District Court to 10 months of imprisonment for fraud and larceny, and completed the execution of the sentence on October 15, 2017.

The Defendant, “2018 Highest 6132” with C, who drinks alcoholic beverages together with C, received a check from C to withdraw cash of KRW 300,000,000, using the above check card and password. The Defendant, upon receipt of a request from C, was willing to withdraw the deposit at will using the above check card.

On June 21, 2018, the Defendant, at around 05:02, withdrawn total of KRW 5,600,000 from July 22, 2018 to June 22, 2018, a total of KRW 300,000,000, from the date of cash withdrawal managed by the victim G located within the “F” convenience store located in Nam-gu Incheon Metropolitan City, Incheon, by allowing the Defendant to withdraw KRW 300,00,000, which is the victim’s own cash from the said cash withdrawal store using the above check card without authority.

On July 17, 2018, the Defendant: (a) around 02:35, 2018, at the front of “I” located in the Bupyeong-gu Incheon Bupyeong-gu, Incheon; (b) opened a door that the victim J did not correct the vehicle's own cash 40,000 won and a half of the market price of the victim's own cash 40,000 won and a half of the market price in which the victim J was parked; and (c) stolen the victim's property located in the vehicle parked three times from that time until July 24, 2018, respectively.

On July 9, 2018, the Defendant posted a false statement that “I will sell air conditioners” on the Internet LM car page at the French site on July 9, 2018, and that I would send air conditioners first to the victim N who contacted.

However, the defendant is guilty.
