1. Defendant A, B, C, and D are jointly and severally liable to the Plaintiff for payment of KRW 260,750,000 and the Defendant from March 25, 2016.
Reasons
1. Facts of recognition;
A. The Plaintiff is a company engaged in the processing and selling of by-products, etc. of livestock products. The Defendant Company A (hereinafter “Defendant Company”) is also a company engaged in the processing and wholesale business of agricultural, fishery, and livestock products. Defendant B served as the representative director of the Defendant Company from January 4, 2016 to April 12, 2016, and Defendant F served as the head of the Defendant Company’s business.
B. A transaction between the Plaintiff and the Defendant Company on March 2016, the Plaintiff entered into a continuous supply contract with the Defendant Company for the supply of the by-products from the Gyeyang-gu G Apartment 124 Dong-dong 701 (hereinafter “instant apartment”) around March 2, 2016, and the Plaintiff provided a security deposit of KRW 350 million or any corresponding security to secure the payment from the Defendant Company. Accordingly, the Plaintiff, on March 2, 2016, issued a contract for the continuous supply of by-products from the Plaintiff to the Defendant Company.
)에 관하여 채무자 피고 회사, 채권최고액 3억 5,000만 원의 근저당권설정등기를 마쳤다. 2) 피고 회사는 2016. 3. 5. 원고에게 무뼈닭발(냉동) 25톤, 공급가액 2억 5,750만 원어치를 주문하였고, 원고는 2016. 3. 11.부터 2016. 3. 25.까지 사이에 위 주문대로 무뼈닭발 25톤과 이를 적재한 P-Box 1,250개(계속적 공급계약 제3조 제3항에 의하면 P-Box를 반납하지 않을 경우 개당 3,000원 지급)를 피고 회사에 납품하였다.
3) 피고 회사는 무뼈닭발 및 P-Box 대금을 지급하지 않았고, 원고는 2016. 5. 26. 이 사건 아파트에 관하여 임의경매개시결정을 받았다. 다. 이 사건 아파트의 등기 및 점유 관계 1) 이 사건 아파트는 피고 E이 2010년경 분양받아 소유권이전등기를 마치고 거주하던 것으로, 2016. 1. 25. 피고 E으로부터 피고 D 앞으로 소유권이전등기가 마쳐졌다.
