A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 11, 2020, the Defendant posted a false statement to the effect that “to sell cultural merchandise coupons” by accessing B Kapets at the B Kapets and selling merchandise coupons on a bulletin board,” and reported the false statement to the victim C, who called “to send KRW 170,000 if he transfers KRW 170,000 to the victim.”

However, even if the victim receives cultural merchandise coupons from the victim, it was thought that it will be used as living expenses and entertainment expenses, and there was no intention or ability to send cultural merchandise coupons to the victim as agreed with the victim.

Defendant deceiving the victim as above and received KRW 170,00,00 from the victim to the bank account (D) in the name of Defendant on the same day as the price for cultural gift certificates on the same day from the victim, and acquired the total sum of KRW 1,84,063 from the victims 17 times in total through the same manner from February 28, 2020, as shown in attached Table 1.

On February 19, 2020, the Defendant posted a false statement to the effect that “to sell cultural merchandise coupons” by accessing B Kapets at the 2020 Kapets, and that “to send cultural merchandise coupons to 27,000 won” to the victim E who reported and contacted this.

However, even if the victim receives cultural merchandise coupons from the victim, it was thought to use it as a living cost, and there was no intention or ability to send cultural merchandise coupons to the victim as agreed with the victim.

The Defendant: (a) by deceiving the victim as above; (b) received KRW 27,000 from the victim to the Agricultural Cooperative account (F) in the name of the Defendant on the same day as the price for cultural merchandise coupons on the same day; and (c) received total of KRW 1,870,000 from the victims 16 times in total through the same manner from April 3, 2020 through the same method from the time to April 3, 2020.
