Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is a person who is engaged in a new issue or clothes sales business under the trade name of “B.”

No person, without legitimate authority, uses a trademark identical to the registered trademark of another person for goods similar to the designated goods, or uses a trademark similar to the registered trademark of another person for goods identical with or similar to the designated goods, or possesses a trademark identical with or similar to the designated goods on which the registered trademark of another person is indicated,

1. 위조 상품의 판매 피고인은 위조 상품을 구입하여 자신이 운영하는 쇼핑몰 B와 오픈마켓에서 소비자에게 판매하기로 마음먹고, 2013. 4. 29. 별지 범죄일람표 연번 1번 기재 내용과 같이, C에게 상표권자인 일본의 ‘가브시끼가이샤고모데갸류쏭’이 특허청에 제0100131호로 등록한 상표인 ‘COMME des GARCONS’ 상표와 동일 또는 유사한 상표가 사용된 위조 꼼데가르숑 가디건 1개를 310,000원에 판매한 것을 비롯하여, 그 때부터 2013. 9. 4.까지 별지 범죄일람표 연번 1번 내지 연번 95번, 연번 97번 내지 연번 127번 각 기재 내용과 같이, 총 126회에 걸쳐 위조 상품인 꼼데가르숑 가디건 1개 등 각종 위조 상품 524개(정품 시가 : 56,297,690원 상당)를 소비자에게 판매하였다.

2. Import and possession of forged goods;

A. On July 17, 2013, the Defendant: (a) purchased from China for the purpose of selling a forged search box using a trademark identical or similar to the trademark registered under Article 0756432, which is the trademark right holder of the U.S., “Macoski and LELC” from Korea; (b) purchased from China for the purpose of selling a forged search box using a trademark identical or similar to the trademark registered under Article 0756432 at the Korean Intellectual Property Office; and (c) carried it into the third designated storage place of the Incheon medium-gu Incheon Customs Office located under 82-19.

B. Around September 5, 2013, the Defendant entered the list of offenses No. 128 in the annexed sheet of crimes.
