A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. In order to sell obscene materials for commercial purposes, the Defendant, from around July 2009 to around July 16, 2014, was admitted to 6 web site, 30 Internet secret camera, 1 social network services, and 6 computer hard disks, 6 children and juveniles’ obscene materials posted on the Defendant’s home, and 223,428 (47GB) as indicated in the attached Table of Crimes (1) by collecting and possessing obscene materials for commercial purposes, in total, 223,428 (47GB).
2. On May 30, 2012, from around May 18, 2014 to around May 18, 2014, the Defendant selling obscene materials for profit-making purposes, posted an advertisement for selling obscene materials produced for children and juveniles who have been collected and held in the same manner as the foregoing paragraph (1), and for selling obscene materials (one-day DNA) to the Internet secret camera, and sells obscene materials produced for them through e-mail, by receiving from the buyers who have contacted the Defendant’s advertisement the amount of KRW 5,00 per 5GB per 5GB from the buyers who have visited him/her, and selling obscene materials produced for them through e-mail, such as the list of crimes (2) in the attached Form 217, by receiving a total of KRW 1,269,500 from 42 persons, and selling obscene materials for profit-making purposes.
3. From September 29, 2013 to May 17, 2014, the Defendant exhibits obscene materials for commercial purposes, for children and juveniles, uses children and juveniles on the bulletin board, such as the above confidential carpet, to operate the “E” as a member of the “G”, “F”, and “social network (SNS) at the same place as the above paragraph (1). In order to sell obscene materials for commercial purposes by downloading more children and juveniles, the Defendant is using children and juveniles on the bulletin board.
