B은 2018. 2. 12. 00:40 경 전주시 덕진구 D에 있는 ‘E’ 음식점에서 일행인 피고인 A과 함께 술을 마시다가, 그 곳 화장실에서 세면대에 가래침을 뱉어 F으로부터 지적을 받자 F을 따라 나가, 계산을 하고 위 음식점을 나가려고 하는 F과 그 일행인 피해자 G(46 세), 피해자 H(42 )에게 “ 야, 이 씹할 놈 아, 싸지 한번 먹게 이리 와 봐! ”라고 말하였다.
