1. The defendant shall pay 617,300 won to the plaintiff and 12% per annum from March 19, 2020 to the day of complete payment.
Reasons
The Plaintiff asserted as to the cause of the claim. Therefore, the Defendant is obliged to pay the Plaintiff the amount of damages 310,000,000 won due to the Defendant’s tort and damages for delay.
Facts of recognition
The Plaintiff operates the instant aquaculture and the F in Tong Young-si, and the Defendant, from October 16, 2015 to February 2, 2019, was engaged in the overall management of the aquaculture, such as cultivating and distributing fish, which is kept in the aquaculture, while serving as a field manager at the instant aquaculture from October 16, 2015 to February 2, 2019.
At around 14:00 on February 7, 2016, the Defendant spreaded 65,00,000 won of the market price of 51,00,000, which was while on duty for the Plaintiff, for the purpose of collecting for the Plaintiff without the Plaintiff’s permission, and used it for personal consumption. At around that time, the Defendant embezzled 68,00,00 won of the total of seven times from October 1, 2018 by arbitrarily consuming 617,30,00 won of the fish.
[Grounds for recognition] Fact-finding, Gap evidence Nos. 1 through 4, and the purport of the entire pleadings are as follows. According to the above fact-finding, the defendant, from February 7, 2016 to October 1, 2018, caused damages equivalent to the same amount to the plaintiff by arbitrarily consuming and embezzled 68 fish 617,300 won in total, seven times from October 1, 2018, and thereby causing damages to the plaintiff. Thus, since the amount of damages 617,300 won as well as the day following the delivery of a copy of complaint of this case filed by the plaintiff, which is sought by the plaintiff as a tort, is different from March 19, 2020.
