Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On December 12, 2017, the Defendant: (a) driven BMW520D car around 11:30, while driving the BMW 520D car and driving it along the two-lanes from the opposite side of the water course to the opposite side of the traffic distance of the victim E (WW 38 years old); (b) moving the vehicle to the right side of the victim and driving it as if TG car interferes with the course; (c) moving the vehicle into the right side of the victim; and (d) moving the vehicle at approximately 100 meters away from the opposite side of the victim; and (d) moving the vehicle to the two-lane of the victim; and (e) moving the vehicle to the two-laneed one of the two-lanes of the victim; and (e) resulting in the difference of the victim as the front part of the victim.

Accordingly, the defendant assaulted the victim by using a dangerous object.

The defendant and his defense counsel asserted that "the defendant and his defense counsel did not have any intention to drive retaliation against the defendant, since they only stopped at the rapid speed of the damaged vehicle and at the rapid speed, and the victim could not intentionally stop and cause any accident because they did not intentionally stop."

그러나 위 증거에 의하여 인정되는 사정 즉, 피고인은 피해 차량이 옆 차로에서 속도를 줄이지 않고 진입하자 편도 3 차로의 도로 중 2 차로에서 주행을 하다가 피해차량이 같은 차로 뒤에서 주행 중인 사실을 알고 있으면서도 갑자기 제동한 점, 당시 피고인 차량의 주행 차로 전방에는 진로를 방해하는 상황이 없어 급제동할 만한 사정이 없었던 점, 피고인은 급제동 후 피해차량에 다가가 ‘ 그렇게 나오는 게 어딨냐
