Defendant shall be punished by a fine of KRW 5,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. On October 19, 2013, the Defendant violated the Road Traffic Act (unlicensed driving) and driven a D Ecoos car from a section of about 500 meters up to the 4-distance intersection in front of the Simban Island located in the Simban-dong, Busan, without obtaining a driver’s license on October 19, 2013.
2. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents and the Road Traffic Act and the Defendant violated the Road Traffic Act driving the above Ecoos car without obtaining the driver’s license as stated in paragraph (1) and driving the above Ecoos car, leading the road to the front of life fisheries in the Si/Gun/Gu of Suwon-gu of Busan, on the side of the Si/Gun/Gu.
Since the above intersection is a place where traffic control is not performed, if the same vehicle intends to enter the intersection at the same time, there was a duty of care to thoroughly see the front side and the right side of the driver and to yield the course to the right side of the road.
Nevertheless, the Defendant neglected this and failed to find out the FMW car driven by the victim E (the aged 33) who enters the above intersection in the right direction of theme by negligence, without holding the right direction, and received the part prior to the driver's seat of the above BM car as the front part of the car operated by the Defendant.
At the same time, the Defendant by occupational negligence inflicted injury on the victim E and the victim G (the 52 years old), and the victim H (the 46 years old) with respect to each of the three-day medical treatment, such as salt and tension, and damaged the said automobiles owned by the victim E to cover approximately KRW 6,298,710 for repair costs.
3. Any person who violates the Guarantee of Automobile Accident Compensation Act shall not operate any motor vehicle on a road which is not covered by mandatory insurance, while the accused is not covered by mandatory insurance at the date and time and place indicated in paragraph (1);
