Punishment of the crime
【Criminal Force】 On April 20, 2007, the Defendant was sentenced to five years of imprisonment for fraud, etc. at the Daejeon District Court on April 20, 2007, and was released on March 30, 201 during the execution of the sentence, and the parole period was terminated on November 14, 201.
【Criminal Facts】
1. In early August 2014, the Defendant related to the right to rent a stop board, the Defendant: (a) at the inspection of “D” located in Gangdong-gu Seoul Metropolitan Government D; and (b) at the victim E, the victim E awarded a contract to the Korea Highway Corporation for the right to rent a stop board. Accordingly, the Defendant made a false statement to the effect that the Defendant would guarantee the investment principal and pay a lot of profits every month.
However, there is no intention or ability to pay every month profits even if the spouse of the female farmer received the investment from the victim because the spouse has been awarded a successful bid for the right to lease the highway from the Korea Highway Corporation.
Nevertheless, the Defendant, as above, deceiving the victim and deceiving him/her from the victim under the pretext of investment, shall be KRW 16 million around August 25, 2014, KRW 6.5 million around the 28th day of the same month, and the same year.
9. Around 30.30.00, a total of 35.9 million won, including a sum of 13.4 million won, was received and fraudulently acquired.
