A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On September 17, 2012, the Defendant was sentenced to one year of imprisonment or two years of suspended execution for a violation of the Road Traffic Act at the Jeonju District Court on September 17, 2012, and the said judgment became final and conclusive on November 21 of the same year, and is currently in the grace period.

1. On August 21, 2013, at around 10:35, the Defendant driven a 50c bit bit gate, without a motor device bicycle driver’s license, while under the influence of alcohol 0.219% under the influence of alcohol, from the 10c gate 50c bit gate, the number of which is nonexistent, to the 95nd road of the Jinjin-gu Seoul Metropolitan Government.

2. 공무집행방해, 상해 피고인은 제1항에 기재된 일시에 위 권삼득로 95 앞 도로에서 위 오토바이를 운행하여 신호를 위반하여 진행하던 중 마침 전북지방경찰청 순찰대 소속 경사인 피해자 C에게 위와 같은 음주운전 사실이 발각되자 기분이 나쁘다는 이유로 피해자에게 “내가 뭘 잘못했는데, 씨발놈아”라고 욕설을 하면서 손으로 피해자의 멱살을 잡아 흔들고 주먹으로 피해자의 얼굴 등을 수 회 때리는 등 경찰관의 교통단속 및 범죄수사업무에 관한 정당한 직무집행을 방해함과 동시에 피해자에게 약 2주간의 치료를 요하는 경추부염좌 등의 상해를 가하였다.
