A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 27, 2014, around 15:30, the Defendant: (a) committed an assault on D’s shoulder at the bus stops located in Gwangjin-gu Seoul Special Metropolitan City, Gwangjin-gu, Seoul, for the reason that D’s security guards, a police officer belonging to the Seoul Mine Police Station C District, who was dispatched to the site after receiving 112 reports that “the passengers under the influence of alcohol are leaving the bus without getting off the bus”; and (b) D’s police officers, a police officer belonging to the Seoul Mine Police Station C District, who was dispatched to the site, boomed the Defendant who was under the influence of alcohol in the bus, and demanded the getting out of the bus.

Accordingly, the defendant interfered with the legitimate execution of duties concerning the handling of reports and maintenance of order by police officers.

2. Definating;

A. On April 27, 2014, at around 15:30 on April 27, 2014, the Defendant insulting the victim D, the Defendant stated that “the bit of bitch bitch bitch bitch bitch bitch bitch bitch bitch,” which was sent to the site by the bus engineer F and G on the same grounds as above, refers to the victim guards D.

Accordingly, the defendant openly insultingd the victim.

나. 피해자 H에 대한 모욕 피고인은 2014. 4. 27. 15:50경 제1항 기재 장소에서, 위 D의 지원 요청을 받고 현장에 출동한 서울광진경찰서 C지구대 소속 경찰관인 피해자 경사 H으로부터 버스에서 하차하라는 말을 들었다는 이유로, 그곳에 있던 여러 명의 버스기사들이 듣고 있는 자리에서 피해자에게 “니미 씨발놈아, 좆같은 새끼야, 한 주먹거리도 안 되는 놈이 어디서 까불어. 좆까는 소리 하지 말고 가라. 이 짭새 새끼들아. 놀고 있네.”라고 말하였다.

Accordingly, the defendant openly insultingd the victim.

C. At around 16:50 on April 27, 2014, the Defendant’s insultd the victim I, who was arrested and detained in the act of obstruction of performance of official duties in the C District located in the Gwangjin-gu Seoul Special Metropolitan City, and was working in the Seoul Mine Police Station C District, where other persons involved in the case who were arrested and detained in the act of obstruction of performance of official duties.
