The defendant's appeal is dismissed.

1. The sentencing of the lower court (two million won of a fine) is too unlimited and unfair.

2. In full view of the following circumstances: (a) there was no repayment of damage to the instant crime at all; (b) the victim was punished for the Defendant; (c) the Defendant was punished five times due to the same crime (three times of imprisonment with prison labor; and (d) there was no change in circumstances or circumstances that may newly be considered in sentencing after the sentence of the lower judgment was rendered; and (c) other circumstances that form the conditions for the argument and sentencing as indicated in the instant case, such as the Defendant’s age, character and conduct, environment, motive and background of the crime, means and method of the crime; and (d) the circumstances after the crime was committed, the Defendant’s assertion is not acceptable, since the sentence imposed by the lower court

3. The defendant's appeal is dismissed as it is without merit. It is so decided as per Disposition.
